Applicability

The following indication will inform you about the processing of your personal data by eAs efficient actuarial solutions GmbH (“eAs”) and about your rights which you are entitled under applicable data privacy laws.

Legal

The processing of your personal data takes place in accordance with the Federal Act on Data Protection (FADP) of the Swiss Confederation as well as all other relevant applicable laws.

Tracking technologies

Tracking technologies are various methods and tools used to monitor users’ behavior and activities on the Internet, with the aim of further improving the website for the user. This includes collecting, storing and analyzing data on how users interact with websites and online services. The most common tracking technologies include:

a) Cookies are small text files that are stored locally when visiting a website on the computer of the user. The text files store data about the behavior of the user. If the user visits the website again, the locally stored text file, from the same web server from which it was created, can also be read again in order to use the information to perform analyzes and statistical evaluations.

b) Pixel-Tags (web beacons) are tiny, invisible images embedded on a webpage or in an Email to track when the user has visited the page or opened the Email.

c) Browser-Fingerprinting is a method of collecting various information about a user’s web browser and device to uniquely identify them.

d) Cross-device tracking uses techniques to track the behavior of a user on different devices and platforms (e. g. smartphone, tablet, desktop).

e) Server-Logs are files that are stored on the server of a website and contain information about access to the website, such as IP addresses, timestamps and requested pages.

The tracking technologies we use are operated exclusively by third-party providers.

You will find an overview of the third-party providers and tracking technologies used in the section Services of the tracking settings. This shows which third-party provider and for what purpose receives access to information on your end device and/or processes your personal data. The tracking technologies are categorized into two Service groups: Essential media and External media. External media are deactivated by default. Your consent is always required for their use.

Consent to the use of tracking technologies

By clicking “Accept all”, you agree that we and all third-party providers listed in the section Services may use the tracking technologies described therein on our website for the purposes stated. This means:

  • Access to information stored on your terminal device and / or the storage of information on your terminal device (consent according to article 45b, article 45c TCA). This includes, for example, the setting and reading of cookies on and from your browser.
  • Creation of individual user profiles from the collected personal data, which are combined with personal data from your use of other websites (consent according to article 6 paragraph 6 FADP or article 17 paragraph 1 a) FADP).

You can customize the selection of the third-party providers you allow for External media under tracking settings in the section Services. By clicking on “Save selection”, you consent to the use of tracking technologies in accordance with your selection.

If you wish to reject the use of tracking technologies by us and all third-party providers listed under External Media, you can first click on “Reject all” under Service groups and then “Save selection”.

Data processing of eAs

The only processing of personal data on our part occurred through filling and sending the contact form to eAs or sending an e-mail to eAs or calling the contact person of eAs. The transmitted personal data (last name, first name, e-mail address and/or phone number, address data) are used exclusively for the communication between the user and eAs.

The transmission of your data via our contact form is encrypted to protect against misuse by third parties. For this we use TLS (Transport Layer Security). It can lead to misuse of the connection by third parties despite encryption. We can’t guarantee the security of the data transmitted to us via the Internet.

Data storage of eAs

The storage of your personal data on our part takes place exclusively for the perception of our tasks and for the legally prescribed retention periods.

An immediate deletion of your personal data in accordance with the legally prescribed retention periods takes place if they are no longer needed for the purposes for which they were collected or the consent of a data processing is revoked by you.

Data transfer to a third country

By visiting our website you are in Switzerland and thus in a third country.

As soon as you contact us, we process and store your data as described in this document in accordance with the FADP and all other applicable laws.

A transfer of your personal data on our part to another third country (states outside the European Union or the European Economic Area) does not take place.

Some third-party providers whose tracking technologies are used on our website are in countries that do not have a level of data protection comparable to Switzerland or the EU (e. g. the USA). There, government agencies (e. g. intelligence services) may have unrestricted access to your personal data and you have no effective legal protection against this access. By clicking “Accept all” or “Save selection” and agreeing to tracking technologies, you also consent to the transfer of your data to third-party providers in these countries (consent according to article 17 paragraph 1 a) FADP).

Transfer of personal data within eAs

If required, your personal data will only be passed on within the eAs in order to be able to answer your request efficiently. A transfer or sale of your personal data to third parties is excluded.

Your rights

You as a user of our website has the right of access about the processing of your personal data according to article 25 FADP provided that the processing is carried out exclusively by eAs.

You have the right to issue your personal data, in a standard electronic format, if the processing of the data is automated (data output and data transfer) according to article 28 FADP.

You have the right to rectification of your inaccurate personal data according to article 32 paragraph 1 FADP.

You have the right of lawsuit to prohibit of a certain data processing your personal data for the protection of your personality according to article 32 paragraph 2 letter a FADP in consideration of article 28, 28a and 28g – 28l Swiss Civil Code.

You have the legal right to prohibit a certain disclosure of personal data to third parties by legal action based on article 32 paragraph 2 letter b FADP.

You have the right to sue for the deletion or destruction of your personal data according to article 32 paragraph 2 letter c FADP under certain circumstances.

You have the right to raise a notation if neither the accuracy nor the inaccuracy of the personal data in question can be established according to article 32 paragraph 3 FADP.

You have the right of notification or publication of the judgment to third parties in case of correction, deletion or destruction of personal data, prohibition of processing or disclosure to third parties, as well as the note indicating the objection based on article 32 paragraph 4 FADP.

Validity

The eAs reserves one’s right to change the privacy terms at any time in accordance with applicable laws.
